These Terms of Service ("Terms") govern your use of the HyvaGo website (hyvago.com) and any development services provided by HyvaGo ("we", "us", "our"). By using this site or engaging our services you agree to these Terms.

1. Services

HyvaGo provides Magento 2 frontend development services including Hyvä theme builds, Luma-to-Hyvä migrations, module compatibility work, and ongoing support retainers. Specific deliverables, timelines, and pricing for each engagement are agreed in a separate written Statement of Work (SOW) or proposal.

2. Enquiries and Quotes

Submitting a project brief or contact form does not constitute a contract. Work begins only after a signed agreement or written confirmation of a proposal from both parties.

3. Payment

• Fixed-price projects require a deposit (typically 50%) before work begins; the balance is due on delivery.
• Retainer services are billed monthly in advance.
• Invoices are due within 7 days unless otherwise agreed in writing.
• Late payments may incur interest at 2% per month on the outstanding balance.

4. Delivery Timelines

The committed delivery timeline will be fully maintained if the server is purchased through us. This allows us to manage deployment, environment setup, and configuration without dependency on third-party access or delays.

If you require a complete server setup, Magento installation/configuration, migration support, performance optimization, or any additional custom work on your own infrastructure, then the delivery timeline may follow standard implementation timelines depending on the scope of work. An updated timeline will be agreed in writing before the engagement begins.

5. Revisions and Scope

Each project includes a defined revision allowance stated in the SOW. Work outside the agreed scope is quoted and billed separately. We will notify you before proceeding with out-of-scope work.

6. Client Responsibilities

You agree to provide timely access to your Magento environment, necessary credentials, and feedback within the timeframes agreed in the project plan. Delays caused by late feedback or access issues may shift delivery dates accordingly.

7. Intellectual Property

Upon receipt of final payment, you own the custom code created specifically for your project. HyvaGo retains the right to use general techniques, methodologies, and non-proprietary code components in future projects. We may reference your project name (not confidential details) in our portfolio unless you request otherwise in writing.

8. Third-Party Software

Hyvä theme licences, Magento extensions, and other third-party software remain subject to their respective licence terms. HyvaGo is not responsible for third-party software limitations, bugs, or licence costs.

9. Warranties and Liability

We warrant that our work will be performed with reasonable skill and care. We do not warrant that a completed theme will be free from all bugs indefinitely, as Magento updates and third-party extensions may introduce compatibility issues after handover.

Our total liability in connection with any engagement is limited to the fees paid by you for that specific engagement. We are not liable for indirect, consequential, or lost-profit damages.

10. Confidentiality

Both parties agree to keep confidential any non-public business information shared during an engagement. A formal NDA is available on request at no extra charge.

11. Cancellation and Refunds

• If you cancel before work begins, the deposit is refunded in full.
• If you cancel after work has begun, you will be invoiced for work completed to date; any overpayment above that amount will be refunded.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Continued use of this site constitutes acceptance of any updates.
